Marijuana Paraphernalia Charges Under Texas Law

Texas Health and Safety Code §481.125 defines three distinct offense tiers, each carrying different consequences. The definition of paraphernalia under §481.002(17) is deliberately broad: any equipment, product, or material used or intended to be used to plant, grow, harvest, manufacture, process, test, store, contain, or ingest a controlled substance. Pipes, bongs, grinders, rolling papers, vape pens used for THC, small bags with residue, and scales have all been charged under this statute.

What matters legally isn’t an item’s appearance. The prosecution must prove it was knowingly used or intended for use with a controlled substance. That’s a meaningful burden, and it’s one we challenge directly.

The three offense tiers are:

  • Class C misdemeanor (§481.125(a)): Using paraphernalia, or possessing it with intent to use, in connection with a controlled substance. No jail time, but a fine up to $500 and a permanent criminal record.
  • Class A misdemeanor (§481.125(b)): Delivery or possession with intent to deliver. Up to one year in county jail and a fine up to $4,000.
  • State jail felony (§481.125(c)): Delivery to a minor at least three years younger. Between 180 days and two years in a state jail facility, plus a fine up to $10,000.

Even a Class C conviction carries consequences beyond the fine. Under Texas Transportation Code §521.372, a drug-related conviction can put your driver’s license at risk. For a first-time misdemeanor paraphernalia conviction, a court may order a suspension if it determines that is in the interest of public safety. If you have a prior drug conviction within the preceding 36 months, suspension is automatic. The suspension period under the statute is 90 days. A conviction also appears on background checks and can affect professional licensing in nursing, law, and real estate; employment in healthcare, education, and transportation; and eligibility for federal student aid.
